Terms of Service
Article 1 (Definitions)
These Terms of Use (hereinafter referred to as the "Terms") apply to all relationships between users (as defined in Paragraph 3 of this Article) and Alpico Kotsu Co., Ltd. (hereinafter referred to as the "Company"), as well as bus operators (as defined in Paragraph 5 of this Article), in connection with the use of the route bus reservation website operated by the Company (hereinafter referred to as the "Website").
The terms used in these Terms shall have the meanings set forth below:
- "Terms" means these Terms, which constitute the conditions of the contract governing the use of the Services entered into between the Company, users, and ticket-purchasing companies.
- "Services" means the route bus reservation website operated and managed by Alpico Kotsu Co., Ltd. for the purpose of reserving highway buses and related services via the Internet.
- "User" means a person who has agreed to these Terms and completed the prescribed member registration or reservation registration on the Website.
- "Non-member Reservation" means the temporary use of the Website without member registration by registering the user's name, email address, and telephone number. These Terms shall also apply to such cases.
- "Bus Operator" means the business entity that operates the bus service reserved or purchased through the Services and bears responsibility under the transportation contract for such bus service.
- "Account Number" means the email address and password registered by a user at the time of member registration on the Website. In the case of a Non-member Reservation, it means the user's name, email address, telephone number, boarding date, and bus service number.
- "Application for Use" means the act by an applicant wishing to use an account number to apply for use registration by completing the prescribed procedures on the Website.
Article 2 (Scope of the Terms)
- These Terms apply to all users of the Services. By clicking the "Agree" button on the Terms display screen, users are deemed to have expressed their consent to and acceptance of these Terms.
- Any transportation contract for bus services reserved or purchased through the Services shall be formed between the user and the relevant Bus Operator. Matters relating to ticket handling, fare collection, refunds, operation, delays, suspensions, accidents, and other operational matters shall be handled by the Bus Operator in accordance with its transportation terms and conditions and under its own responsibility.
- Except for the provision of reservation, payment, and other systems offered through the Services, the Company shall not be a contracting party with respect to transportation matters described in the preceding paragraph and shall not, in principle, bear responsibility for such matters.
Article 3 (Membership Number)
The Website shall provide users with a membership number for the purpose of using the Services.
Article 4 (Member Registration)
- Any person wishing to use the Website shall apply for use registration personally in accordance with the prescribed procedures on the Website.
- Applicants shall provide and register all information concerning themselves accurately and agree to keep such registered information current, complete, and accurate at all times in accordance with these Terms.
- If deficiencies or errors in the registered information cause an impediment to the provision of services under Article 8, the Website may suspend the provision of such services without prior notice. In such cases, the Company shall not be liable for any disadvantage suffered by the user, unless caused by the Company's willful misconduct or gross negligence.
- Users shall promptly register any changes to their registered information. The Company shall not be liable for damages arising from a failure to register such changes, unless caused by the Company's willful misconduct or gross negligence. Even if changes are registered, transactions already processed prior to such registration may be conducted based on the pre-change information. Users agree in advance that notices from the Website shall be deemed to have arrived at the normally expected time even if they do not actually reach the user due to failure to complete change registration.
- The Company shall register and own, in its database, information reported by users at the time of member registration and information obtained during the use of the Services, except as provided in Article 13.
Article 5 (Refusal of Account Registration)
The Company may refuse an application for use if the applicant falls under any of the following:
- The applicant has previously had user status suspended or revoked due to violations of user agreements relating to the Website.
- False statements, errors, or omissions exist in the application.
- The applicant is a minor or a person under guardianship, curatorship, or assistance and has not obtained the legally required consent or involvement of a legal representative.
- The applicant violates or has previously violated Article 14, Paragraph 3.
- There is a risk of violation of these Terms.
- Valid authorization cannot be obtained for the payment method designated by the applicant.
- The Company reasonably determines that registering the applicant as a user is inappropriate.
Article 6 (Account Management Responsibility)
- Users shall bear full responsibility for the use and management of their assigned Account Number and shall not allow third parties to use it, nor lend, transfer, change ownership, sell, pledge, or otherwise dispose of it.
- Users shall bear responsibility for any damages arising from inadequate account management, misuse, or use by third parties. The Company shall not be liable unless caused by its willful misconduct or gross negligence.
- If a user becomes aware that their Account Number has been stolen or used by a third party, the user shall immediately notify the Website and follow any instructions given.
- The Company shall not be liable for damages suffered by a user due to use of the Account Number by a third party, unless caused by its willful misconduct or gross negligence. Any use made under the Account Number shall be deemed to have been made by the relevant user, who shall bear all obligations arising therefrom.
- The provisions of this Article shall also apply to Non-member Reservations.
Article 7 (Suspension or Revocation of User Status)
- If a user falls under any of the following, the Company may immediately suspend or revoke the user's status without prior notice. However, if the user has used the Services before cancellation of the application or deletion of the account number and a contract for service use under Article 8 or a purchase contract under Article 10 has been validly formed, the user shall remain liable for obligations arising from such purchase contract.
- False declarations were made in the application.
- The user engaged in prohibited acts under Article 14.
- The user violated these Terms.
- The Company can no longer contact the user due to changes in address or email address.
- The user interfered with the operation of the Website.
- The Company reasonably determines the user to be inappropriate.
- The Company shall not be liable for damages arising from suspension or revocation of user status, unless caused by its willful misconduct or gross negligence. Even if measures are taken due to violation of Article 14, Paragraph 3, the user shall not claim compensation for any resulting damages.
Article 8 (Scope of Services Provided)
- Users may use the following services. For items 3 and 5, credit card information must be registered or entered.
- Seat availability inquiry and reservation registration
- Confirmation, modification, and cancellation of reservations
- Credit card payment of bus fares
- Display of boarding tickets
- Refunds for payments made under item 3
- Modification of member information
- Bus reservation services are provided only for routes, services, and seats authorized by the Bus Operators.
- The Services may be used via computers, smartphones, tablets, or other devices; however, some devices or models may not be supported.
- The Services are provided free of charge, and the Company does not charge handling fees. Users shall bear communication charges incurred.
- Service hours are from 4:00 a.m. to 2:00 a.m. (Japan Standard Time). Service hours may be changed due to maintenance, temporary suspension, force majeure, or other circumstances. Except in cases of willful misconduct or gross negligence, the Company shall not be liable beyond direct and ordinary damages resulting from suspension or interruption.
Article 9 (Reservations)
- At the time a reservation confirmation email is sent, the reservation is deemed a provisional reservation with the Bus Operator, and boarding is not permitted at this stage. Users must purchase tickets at designated counters, via credit card payment, or through affiliated services.
- A provisional reservation becomes final upon purchase of the ticket.
- Some routes have purchase deadlines. Failure to purchase by the deadline will result in cancellation of the provisional reservation.
Article 10 (Payment, Ticket Issuance, and Refunds on the Website)
- Payment and ticket issuance are deemed completed when a ticket issuance email is sent or when issuance is displayed on the confirmation screen.
- Refunds for tickets issued on the Website shall be processed via prescribed methods on the Website and are subject to refund deadlines.
- Refund fees shall follow the Bus Operator's transportation terms.
- Final decisions regarding refunds, conditions, amounts, and deadlines are made by the relevant Bus Operator.
- The Company may act as an agent for refund procedures but does not bear refund obligations itself.
- Users agree in advance that refunds may not be available after deadlines or in non-refundable cases pursuant to the Bus Operator's terms.
Article 11 (Cancellations Due to Suspension, Delay, etc.)
- In cases of suspension, cancellation, or significant delay due to weather, disasters, accidents, or other causes, handling of cancellations, refunds, or alternative arrangements shall be determined by the relevant Bus Operator.
- Refund conditions may vary by Bus Operator, and users agree that such conditions are not uniform.
- The Company may provide information or act as an intermediary but bears no independent responsibility for such decisions.
Article 12 (Notices to Users)
Notices regarding operation of the Website, including revisions, additions, changes, or discontinuation of services, shall be provided on the Website.
Article 13 (Outsourcing of Credit Card Payment Processing)
- The Company outsources credit card payment processing to DG Financial Technology, Inc. ("DGFT").
- Users consent to DGFT acting as payment agent and to disclosure of necessary payment information to DGFT.
- Credit card information registered by users is stored by DGFT, and the Company does not retain such information.
Article 14 (Prohibited Acts)
- Users shall not engage in the following acts:
- • Acts causing or likely to cause damage to the Website or Bus Operators
- • Unauthorized use of account numbers
- • Use or provision of harmful programs
- • Acts causing inconvenience, violating public order, or violating laws
- • Fraudulent reservations such as multiple bookings
- • Other acts deemed inappropriate by the Company
- Users shall not engage in fraudulent credit card use or other acts deemed inappropriate by card issuers or financial institutions.
- Applicants represent and warrant that they are not affiliated with antisocial forces and shall not engage in violent or coercive acts or actions damaging the Company's or Bus Operators' credibility or operations.
Article 15 (User Responsibility)
Users are responsible for account management, appropriate usage environments, compliance with laws and rules, payment of communication charges, and compensation for damages caused by violations of these Terms.
Article 16 (Important Notes Regarding the Services)
The Services rely on Internet communication and systems and may be unavailable due to various risks. Security measures are implemented within reasonable limits but do not guarantee complete safety.
Article 17 (Company Liability)
The Company's liability is limited to direct and ordinary damages caused by willful misconduct or gross negligence, up to the amount paid by the user for the relevant reservation.
Article 18 (Personal Information Protection)
Personal information shall be handled in accordance with the separately established Privacy Policy.
Article 19 (Ownership of Rights)
All rights relating to the Services belong to the Company, and users shall not infringe upon such rights.
Article 20 (Inquiries)
The Company accepts inquiries related only to the Services. Inquiries regarding bus operations shall be directed to the Bus Operators.
Article 21 (Changes to the Services)
The Company may reasonably change the Services and shall notify users in advance where applicable.
Article 22 (Amendments to the Terms)
The Company may amend these Terms under reasonable circumstances and shall notify users accordingly. Continued use constitutes acceptance.
Article 23 (Termination of the Services)
The Company may terminate the Services in whole or in part, with prior notice where possible, and shall not be liable except in cases of willful misconduct or gross negligence.
Article 24 (Severability)
If any provision is held invalid, the remaining provisions shall remain effective.
Article 25 (Language, Governing Law, and Jurisdiction)
- The Japanese version shall prevail over the English version.
- These Terms shall be governed by Japanese law.
- The Matsumoto Branch of the Nagano District Court or the Matsumoto Summary Court shall have exclusive jurisdiction.
